X (formerly Twitter) has been using unlawful practices for years to generate more visitors and advertising revenue. Through manipulative practices – combined with a lack of transparency about the use of consumer data – X unfairly profits from its millions of users.

For years, X has manipulated its users by providing insufficient openness about how (sensitive) data is used to reinforce BigTech practices. Systematically, data breaches are kept hidden, insufficient action is taken against hate speech, and investigations are severely hindered. Additionally, X manipulates its users by offering advertisements that (illegally) target political and religious preferences. And that without the knowledge of the X user. 

SOMI wants this to stop. SOMI is committed to addressing these issues: to do justice to consumers by demanding more freedom of choice and transparency, and to compensate for the damage and unlawful enrichment caused by X.

Participation in this action is free of charge and can be alongside or in combination with participation in other claim actions, including previous actions against X in Europe.

What SOMI demands



SOMI demands that X stops illegal activities, such as using sensitive data for targeted advertisements, concealing data breaches, and taking insufficient measures against hate speech. X is currently profiting – at the expense of users – financially to the maximum through these unlawful practices. Therefore, SOMI advocates that X be held accountable and that all affected users be compensated for the damage they have suffered. It is necessary for X to take its responsibility and stop these harmful activities to ensure the privacy and safety of users.

Data breaches

Between January 2022 and January 2023, four data breaches took place at X, leading to personal data of hundreds of millions of users ending up on the Dark Web. In these incidents, X failed to take appropriate security measures and to follow up on the data breaches adequately (by properly informing the authorities and the affected users).

Microtargeting

X has illegally used sensitive data of users, such as political views and religious beliefs, for targeted advertising. X used this sensitive data, among other things, to determine whether an advertising campaign from the European Commission would be shown, which tried to gather support for the proposed controversial chat control regulations in the Netherlands. Subsequently, the public register of X that should provide insight into the targeting criteria of advertisements does not meet the requirements. X has so far, illegally, unchecked been able to proceed.

Hate speech

X falls short in its obligation to take sufficient measures against systemic risks on its platform, including fighting content motivated by hate, prejudice or intolerance. Various studies confirm that hate speech has significantly increased after the acquisition of X by Elon Musk. For its own profit, X displays advertisements next to hate messages and on profiles of X users who post hate speech. Research on X's data by researchers is severely hampered.


These actions violate European and national data protection and consumer laws, including the General Data Protection Regulation (GDPR), the Digital Services Act (DSA) and the Directive on unfair trade practices as implemented in the Civil Code. These actions have caused harm to users and visitors of X.

  1. X has violated your rights – It is essential to address and stop the violation of your rights. Hate speech and hate spreaders must not be disseminated and pushed as a revenue model. Harm as a result of illegal actions must be compensated.

Restore the injustice – This campaign will contribute to restoring justice for consumers, allowing them to make better-informed choices and have more control over how their personal data is used. This contributes to promoting transparency and accountability within digital services like X, and emphasizes the importance of protecting privacy and preventing the misuse of sensitive information.
  3. Stop the manipulation – Sensitive personal data, such as religion and political views, must not be used for targeted advertising, or to exclude groups of people from these advertisements. Protecting sensitive information from misuse contributes to safeguarding the privacy rights of and preventing unauthorized influence on European citizens, who have collectively chosen to be protected in this way.
  4. Together we send a signal – It is of great importance that we collectively send a signal. Large tech companies need to be more active in combating systemic risks, primarily against the increase in hate speech for profit. By working together towards these goals, we can contribute to a safer and more ethical digital environment.
